Proposition 46 – Raising the Medical Malpractice General Damages Cap

Proposition 46 appears to be one of the most hotly contested propositions of this election season. Voters are currently split on the issue of raising the medical malpractice damages cap from $250,000 to $1.1 million dollars.

Our office works with people who have been injured by preventable medical errors every day. We see their suffering and the extremely prohibitive costs of bringing these cases to trial. The current cap was set in 1975 and has not been adjusted for inflation. Proposition 46 raises the cap to where it would have been if the original legislation accounted for inflation.
