The loss of a loved one can be traumatic, especially when the loss is caused by another’s negligence. Unfortunately, negligence places individuals in danger of serious harm or death every day. When one of these tragic incidences does occur, surviving family members may be left asking themselves several questions including ‘why?’ and ‘what happens now?’ One thing these families should consider is taking legal action against the individual and/or company that caused their loss.
A 13-year-old girl has done just that, and was awarded $150 million for the 2009 Wrongful death of her parents. The lawsuit stemmed from a fatal accident involving her parent’s vehicle and a semi-truck. The semi-truck’s driver had pulled to the shoulder of the highway to sleep, even though posted signs indicated stopping was prohibited except for emergencies. Additionally, the truck driver failed to turn on any lights to alert other motorists that he was parked on the shoulder.
